Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and SIA Digital Publisher ("Company", "we", "us", "our"), a company registered in Latvia, governing your use of MarketingRoutine.ai (the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Description of Service

MarketingRoutine.ai is an AI-powered marketing platform that provides:

  • Integration with Facebook and Instagram for message and comment management
  • AI-powered response suggestions for customer inquiries
  • Human-in-the-loop approval workflow for AI-generated responses
  • Analytics and performance tracking for marketing campaigns
  • Multi-channel communication management

3. Account Registration

To use the Service, you must:

  • Create an account with accurate and complete information
  • Be at least 18 years old
  • Have authority to bind your organization (if applicable)
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access

You are responsible for all activities that occur under your account.

4. Platform Connections

When connecting Facebook Pages or Instagram accounts:

  • You must have proper authorization to manage those accounts
  • You grant us permission to access and process data from those platforms
  • You agree to comply with Meta's Platform Terms and Policies
  • You understand that platform API changes may affect Service functionality

5. AI-Generated Content

Our Service uses artificial intelligence to generate response suggestions. You acknowledge that:

  • AI-generated responses are suggestions only and require human review
  • You are responsible for reviewing and approving all responses before they are sent
  • AI responses may sometimes be inaccurate, incomplete, or inappropriate
  • We do not guarantee the accuracy or suitability of AI-generated content
  • Final responsibility for all communications rests with you

6. Acceptable Use

You agree NOT to use the Service to:

  • Violate any laws or regulations
  • Infringe intellectual property rights
  • Send spam, unsolicited messages, or engage in harassment
  • Distribute malware or harmful content
  • Attempt to gain unauthorized access to systems
  • Interfere with the Service's operation
  • Scrape or collect data without authorization
  • Impersonate others or misrepresent your affiliation
  • Use automated means to access the Service (except approved APIs)
  • Violate Meta's Platform Terms or Community Standards

7. Subscription and Payment

7.1 Pricing

Current pricing is available at marketingroutine.ai. Prices are subject to change with 30 days notice.

7.2 Billing

  • Subscriptions are billed monthly or annually in advance
  • Payment is processed securely through Stripe
  • Failed payments may result in service suspension

7.3 Refunds

We offer a 7-day free trial. After the trial period, subscription fees are non-refundable except as required by law.

7.4 Cancellation

You may cancel your subscription at any time. Access continues until the end of the current billing period.

8. Intellectual Property

8.1 Our Property

The Service, including all software, design, text, graphics, and other content, is owned by SIA Digital Publisher and protected by intellectual property laws.

8.2 Your Content

You retain ownership of your data. You grant us a limited license to process your content solely to provide the Service.

8.3 Feedback

Any feedback or suggestions you provide may be used by us without obligation to you.

9. Data Protection

Our collection and use of personal data is governed by our Privacy Policy. By using the Service, you consent to our data practices as described therein.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Merchantability or fitness for a particular purpose
  • Non-infringement
  • Uninterrupted or error-free operation
  • Accuracy or reliability of AI-generated content
  • Security from unauthorized access

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIA DIGITAL PUBLISHER SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or business opportunities
  • Damages arising from AI-generated content
  • Platform API changes or restrictions
  • Third-party actions or content

Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless SIA Digital Publisher from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you send through the Service

13. Termination

We may suspend or terminate your access to the Service:

  • For violation of these Terms
  • For non-payment
  • If required by law
  • If continuing service poses a security risk
  • At our discretion with reasonable notice

Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or prominent notice on the Service. Continued use after changes constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the Republic of Latvia. Any disputes shall be resolved in the courts of Latvia, without prejudice to your rights under EU consumer protection laws.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
